These Terms of Service govern your use of Mobility, a fleet tracking and telematics platform provided by Jeytech. By accessing or using our service, you agree to be bound by these terms.

Acceptance of Terms

By accessing or using Mobility ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Jeytech, a company registered in Kenya ("we", "us", or "our").

Description of Service

Mobility is a fleet tracking and telematics platform that provides:

Real-time GPS tracking of vehicles and assets
Fuel consumption monitoring and analytics
Engine diagnostics and health alerts
Route optimization and trip history
Geofence notifications
Driver behavior monitoring
Fleet management dashboards and reports

The Service is provided on a subscription basis. Specific features and service levels depend on your chosen plan.

Account Registration and Security

To use the Service, you must:

  • Be at least 18 years of age
  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

You are liable for any damage or loss resulting from failure to maintain account security.

Subscription Plans and Billing

The Service is offered on various subscription plans. You agree to:

  • Pay all applicable fees in accordance with the billing terms of your selected plan
  • Provide accurate billing information and authorize us to charge your payment method
  • Maintain current payment information to avoid service interruption
  • Understand that fees are non-refundable except as required by law or specified in our refund policy
⚠️ We reserve the right to modify subscription fees with 30 days prior notice. Changes will not apply to existing subscriptions until the end of the current billing cycle.

Hardware Requirements

To fully utilize the Service, you may need to install compatible telematics hardware in your vehicles. You acknowledge that:

  • Hardware installation must comply with all applicable Kenyan laws and regulations
  • You are responsible for obtaining any necessary permits or authorizations
  • We are not liable for any damage to vehicles during installation or use of hardware
  • Hardware is provided by third-party vendors; warranty claims must be directed to the hardware manufacturer

User Responsibilities

As a user of the Service, you agree to:

  • Use the Service only for lawful purposes and in accordance with these Terms
  • Not use the Service to engage in any fraudulent, illegal, or unethical activities
  • Not attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Not interfere with or disrupt the Service or servers connected to the Service
  • Not introduce viruses, malware, or other harmful code
  • Not use the Service to transmit unsolicited commercial communications
  • Comply with all applicable Kenyan laws, including traffic and data protection laws

Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, and code, are the exclusive property of Jeytech or its licensors and are protected by Kenyan and international copyright, trademark, and other intellectual property laws.

You may not reproduce, modify, distribute, or create derivative works of any part of the Service without our express written consent.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with Kenya's Data Protection Act, 2019.

By using the Service, you consent to the collection and processing of your data as described in our Privacy Policy.

Service Availability and Maintenance

We strive to maintain high availability of the Service. However, you acknowledge that:

  • The Service may be temporarily unavailable for maintenance, updates, or technical reasons
  • We do not guarantee uninterrupted or error-free operation
  • We are not liable for any loss or damage resulting from service unavailability
  • We will provide advance notice of scheduled maintenance when practicable

Limitation of Liability

To the maximum extent permitted by Kenyan law, Jeytech shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, business opportunities, or goodwill
  • Damages arising from vehicle accidents, regardless of whether the Service was used
  • Damages resulting from third-party hardware or software
Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Jeytech and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service will immediately cease.

Sections 7, 8, 10, and 11 shall survive termination of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be resolved through:

  1. 1Good faith negotiation between the parties
  2. 2If unresolved, mediation administered by a recognized Kenyan mediation center
  3. 3If still unresolved, binding arbitration in Nairobi, Kenya in accordance with the Arbitration Act, 1995

Courts in Nairobi, Kenya shall have exclusive jurisdiction over any matters not subject to arbitration.

Modifications, Severability & Entire Agreement

Modifications: We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jeytech regarding the Service and supersede all prior agreements.
